Resumo Omnilex

The husband filed a constitutional complaint against a Zurich Higher Court maintenance order, but the cantonal cassation court later set that order aside. The Federal Supreme Court therefore held the federal proceeding moot and struck the complaint from the docket. It also refused legal aid because the complaint had been directed against a non-final cantonal decision and thus appeared inadmissible. Applying the cited cost practice, the court charged the appellant with CHF 300 in court fees. No compensation was awarded to the wife because she had not been invited to comment.

Sumário Omnilex

Art. 32 Abs. 2 BGG; Art. 132 BGG; mootness of a federal complaint after annulment of the challenged decision by a cantonal authority; the proceeding is to be struck out by the division president as single judge. Art. 152 Abs. 1 OG: legal aid is refused where the remedy is prima facie inadmissible, in particular when directed against a non-final cantonal decision. Costs follow the party who caused the federal proceeding when a parallel cantonal remedy succeeds and renders the federal case moot (Art. 156 Abs. 6 OG). No party compensation is due absent invited observations and recoverable expenses.

Obergericht des Kantons Zürich, I. Zivilkammer, Postfach, 8023 Zürich.

Gegenstand
Art. 9 BV (Eheschutz),

Staatsrechtliche Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, I. Zivilkammer, vom 22. Dezember 2006.

Januar 2007,

in Erwägung,

Whether the constitutional complaint had become moot after the cantonal cassation court set aside the challenged higher-court decision.

Decisão extraída

Yes. The later cassation decision removed the object of the federal complaint, so the proceeding had to be struck out as moot.

Fundamentação extraída

Once the challenged order was annulled by the cantonal cassation court, there was no longer a live controversy before the Federal Supreme Court. Under Art. 32(2) BGG, the matter was therefore to be discontinued by the division president acting as single judge.

Questão jurídica principal

Whether the appellant was entitled to legal aid for the federal proceeding.

Decisão extraída

No. The complaint was prima facie inadmissible because it was directed against a cantonal decision that was not final at the time, so the requirements for legal aid were not met.

Fundamentação extraída

The court held that a constitutional complaint against a non-final cantonal decision appeared inadmissible from the outset. On that basis, the request for free legal aid could not be granted under Art. 152(1) OG.

Questão jurídica principal

Who had to bear the costs of the moot federal proceeding.

Decisão extraída

The appellant had to pay the court fee because he caused the federal proceeding and it became moot only after the parallel cantonal remedy succeeded.

Fundamentação extraída

According to the cited practice under Art. 156(6) OG, the party whose filing caused the federal proceeding must bear the costs when a simultaneously filed cantonal remedy succeeds and renders the federal case moot.

Questão jurídica principal

Whether the respondent was entitled to compensation for the federal proceeding.

Decisão extraída

No compensation was awarded because the respondent was not invited to file observations and incurred no recoverable expenses.

Fundamentação extraída

Without a response brief or other expenses in the federal proceeding, there was no basis for an indemnity.
