The Federal Court dealt with a criminal appeal against a decision of the Zurich High Court. The appellant failed to collect the first order requiring an advance on costs and then also failed to pay the advance within the extended deadline set by the second order, which he did receive. The Court therefore refused to enter the appeal under Art. 108 BGG and ordered him to pay court costs of CHF 800.
Art. 108 BGG; non-payment of the advance on costs after a duly notified grace period results in non-entry into the appeal. Where the appellant, after receiving the second order, still fails to pay the ordered advance by the stated deadline, the Federal Court may decide by summary procedure not to enter on the appeal. Court costs are charged to the unsuccessful party pursuant to Art. 66 Abs. 1 BGG.

Der Präsident zieht in Erwägung:

Der Beschwerdeführer wurde mit Verfügung vom 10. Dezember 2008 aufgefordert, dem Bundesgericht spätestens am 6. Januar 2009 einen Kostenvorschuss von Fr. 1'000.-- einzuzahlen. Er hat die Verfügung auf der Post nicht abgeholt. In der Folge wurde ihm mit Verfügung vom 19. Januar 2009 die gesetzliche vorgesehene Nachfrist zur Vorschussleistung bis 9. Februar 2009 angesetzt mit der Androhung, dass das Bundesgericht ansonsten auf die Beschwerde nicht eintrete. Diese Verfügung hat der Beschwerdeführer erhalten. Indessen hat er den Kostenvorschuss nicht geleistet. Folglich ist auf die Beschwerde androhungsgemäss im Verfahren nach Art. 108 BGG nicht einzutreten.

Die Gerichtskosten sind dem Beschwerdeführer aufzuerlegen (Art. 66 Abs. 1 BGG).
Demnach erkennt der Präsident:

Auf die Beschwerde wird nicht eingetreten.
2.
Die Gerichtskosten von Fr. 800.-- werden dem Beschwerdeführer auferlegt.
3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, II. Strafkammer, schriftlich mitgeteilt.
