Resumo Omnilex

The Federal Supreme Court held that the appellant company, as an injured party invoking only substantive-law violations, lacked standing under Art. 81 BGG to challenge the cantonal non-entry decision in criminal proceedings. The complaint was therefore not entertained under Art. 108 BGG. Court costs of CHF 800 were charged to the appellant under Art. 66(1) BGG.

Sumário Omnilex

Art. 81 Abs. 1 BGG; standing to appeal in criminal matters; an injured party is not entitled to file a criminal appeal merely by alleging violations of substantive law. Such allegations do not substitute for the special requirements of appeal standing. Where standing is lacking, the Federal Supreme Court does not enter into the complaint pursuant to Art. 108 BGG. Court costs are imposed on the appellant under Art. 66 Abs. 1 BGG.

Urteil vom 21. Februar 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________ AG,
Beschwerdeführerin,

gegen

Generalprokurator des Kantons Bern, Hochschulstrasse 17, 3012 Bern,
Beschwerdegegner.

Gegenstand

Whether the injured company had standing to file a criminal appeal to the Federal Supreme Court.

Decisão extraída

No. As an injured party alleging only violations of substantive law, the company was not entitled to appeal in criminal matters.

Fundamentação extraída

Standing is governed by Art. 81(1) BGG. The appellant relied only on alleged violations of substantive law, which is insufficient for victim standing in this context; therefore the appeal was inadmissible under Art. 108 BGG.

Questão jurídica principal

Allocation of court costs

Decisão extraída

The court costs were charged to the appellant.

Fundamentação extraída

Because the appeal was not entertained, the appellant had to bear the court costs under Art. 66(1) BGG.
