Resumo Omnilex

The Federal Supreme Court dismissed, insofar as it entered into the matter, the defendant’s criminal appeal against her cantonal conviction for attempted coercion and defamation. It held that the complaint about website deletion was outside the scope of the appealed judgment, the neutrality complaint was insufficiently reasoned, and the challenge to the denial of truth proof in the defamation count showed no breach of federal law. The cantonal conviction and the suspended fine of 10 daily rates at CHF 20 each remained in place. The appellant was ordered to pay the federal court fee of CHF 1,000.

Sumário Omnilex

Art. 106 Abs. 2 and Art. 109 BGG; scope of review and substantiation requirements in criminal appeals. The Federal Supreme Court examines only the grievances properly directed against the contested judgment and adequately reasoned; matters not included in the appealed decision are inadmissible. Allegations of bias against judges or the clerk must be set out concretely. Where the cantonal court, relying on prior civil findings, denies the admissibility or relevance of truth proof in a defamation case, a mere dissenting view does not establish a violation of federal law. Complaints failing these requirements are dismissed insofar as they are admissible (consid. 2-3).

Urteil vom 8. Juni 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Bundesrichter Wiprächtiger, Ferrari,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführerin,

gegen

Staatsanwaltschaft des Kantons St. Gallen, Spisergasse 15, 9001 St. Gallen.

Gegenstand
Versuchte Nötigung, üble Nachrede,

Beschwerde in Strafsachen gegen den Entscheid des Kantonsgerichts St. Gallen, Strafkammer, vom 5. Februar 2007.

Das Bundesgericht zieht in Erwägung:
1.

3.
Dieses Urteil wird der Beschwerdeführerin, der Staatsanwaltschaft des Kantons St. Gallen und dem Kantonsgericht St. Gallen, Strafkammer, schriftlich mitgeteilt.

Whether the conviction for attempted coercion and defamation should be set aside.

Decisão extraída

The appeal was rejected insofar as it was admissible.

Questão jurídica principal

Whether the complaint concerning deletion of a website could be examined.

Decisão extraída

It could not be examined because the website deletion was not part of the contested decision.

Fundamentação extraída

A matter outside the scope of the appealed judgment is not reviewable in this appeal.

Questão jurídica principal

Whether the complaint about alleged lack of judicial neutrality was sufficiently reasoned.

Decisão extraída

It was not admissible because the appellant did not explain concretely how the judges and clerk lacked neutrality.

Fundamentação extraída

The appeal did not satisfy the reasoning requirement of Art. 106(2) BGG.

Questão jurídica principal

Whether the appellant had to be allowed to prove the truth in relation to defamation.

Decisão extraída

The Federal Supreme Court found no violation of federal law in the cantonal court’s refusal of that challenge.

Fundamentação extraída

The lower court relied on the civil judges’ decisions and concluded that no wrongful conduct by the claimant was apparent; the appellant failed to show why this assessment would breach federal law or entail a hearing violation.
