Resumo Omnilex

The Federal Court held that the complainant lacked standing to challenge the refusal to open a fraud investigation because he had already brought his civil claim against the accused before the civil courts. Since the adhesive civil-claim route was therefore unavailable, the criminal complaint was inadmissible under Art. 81 BGG. The appeal was not entered into under Art. 108 BGG, and court costs of CHF 800 were imposed on the complainant.

Sumário Omnilex

Art. 81 BGG; standing of an injured party to appeal in criminal matters where civil claims are already pending before a civil court. If the injured party has already asserted the relevant civil claim in ordinary civil proceedings, the prerequisite for criminal appellate standing based on the protection of civil claims is lacking; the criminal appeal cannot be used as a substitute for adhesive civil enforcement (consid. 1). Where the appeal is manifestly inadmissible, non-entry follows under Art. 108 BGG, and the costs are borne by the appellant pursuant to Art. 66 Abs. 1 BGG (consid. 2).

Urteil vom 1. Juni 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Graubünden, Sennhofstrasse 17, 7001 Chur.

Gegenstand

1.
Der Beschwerdeführer reichte am 26. Oktober 2006 Strafanzeige gegen A.________ wegen Betrugs ein.

Whether the complainant had standing to bring a criminal appeal under Art. 81 BGG despite an already pending civil lawsuit against the accused.

Decisão extraída

Standing was denied because the complainant had already asserted the civil claim in civil proceedings, so the criminal appeal could not serve as an adhesive claim route.

Fundamentação extraída

The Federal Court agreed that this was a civil-law matter and that a pending action before the civil court excluded the prerequisites for a criminal appeal by the injured party.

Questão jurídica principal

Allocation of federal court costs after non-entry.

Decisão extraída

The federal court costs were imposed on the complainant.

Fundamentação extraída

Because the appeal was not entered into, the losing party had to bear the costs.
