Resumo Omnilex

The Federal Supreme Court did not enter into the appellant's complaint against a Bernese decision converting a CHF 250 fine into 8 days' imprisonment. The challenge to the underlying fine was inadmissible because that conviction was already final. As to the conversion order itself, the Court held that the appellant did not invoke a violation of Swiss law and therefore could not contest the cantonal court's reasoning about his alleged inability to pay. The court fee of CHF 800 was charged to the appellant.

Sumário Omnilex

Art. 95 BGG, Art. 108 BGG, Art. 66 Abs. 1 BGG; complaint against conversion of a fine into imprisonment. A final sanction may not be challenged anew in proceedings directed only against the conversion order. Review by the Federal Supreme Court is limited to grievances alleging a violation of federal law; absent such a legal criticism, the Court does not examine the cantonal assessment of the debtor's financial capacity. Where the appeal is manifestly inadmissible, non-entry is ordered in summary procedure and court costs are borne by the appellant.

Urteil vom 8. Juni 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Generalprokurator des Kantons Bern, Postfach 7475, 3001 Bern.

Gegenstand
Bussenumwandlung,

Strafkammer, vom 24. Mai 2007.

Das Präsidium zieht in Erwägung:
1.

3.
Dieses Urteil wird dem Beschwerdeführer, dem Generalprokurator des Kantons Bern und dem Obergericht des Kantons Bern, 2. Strafkammer, schriftlich mitgeteilt.

Questão jurídica principal

Whether the complaint could attack the underlying final fine conviction.

Decisão extraída

The challenge to the underlying fine was inadmissible because the fine had long been final and could no longer be reviewed.

Fundamentação extraída

A final sanction cannot be reopened in proceedings against the conversion order.

Questão jurídica principal

Whether the conversion of the fine into imprisonment should be reviewed on the basis of the appellant's financial situation.

Decisão extraída

The Federal Supreme Court did not examine the appellant's finances because the complaint did not allege a violation of Swiss law within the meaning of Art. 95 BGG against the cantonal court's reasoning.

Fundamentação extraída

Without a relevant legal complaint, the Court could not engage with the factual assessment of ability to pay; therefore the appeal failed to meet the requirements for review.
