Resumo Omnilex

The Federal Supreme Court held that the appellant’s filing did not meet the minimum reasoning requirements because it failed to engage with the cantonal court’s non-entry reasoning. The appeal was therefore not entered into under Art. 108 BGG. Because the appeal was hopeless, the request for free legal aid was denied. Court costs of CHF 500 were imposed on the appellant, with due regard to his financial situation.

Sumário Omnilex

Art. 42 Abs. 2, Art. 64, Art. 65 Abs. 2 and Art. 108 BGG; admissibility of a federal appeal and free legal aid. A federal complaint must, in reasoned form, specifically engage with the challenged decision and set out why it is unlawful; mere reference to the file or purely substantive argumentation does not satisfy the motivation requirement. If the pleading is manifestly insufficiently reasoned, the court may not enter into the matter under Art. 108 BGG. A request for legal aid is to be refused where the appeal lacks prospects of success. When allocating costs, the court may take the party’s financial situation into account.

Urteil vom 5. März 2013
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft Zürich-Limmat,
Stauffacherstrasse 55, 8004 Zürich,
Beschwerdegegnerin.

Gegenstand
Einstellung,

Beschwerde gegen den Beschluss des Obergerichts
des Kantons Zürich, III. Strafkammer,
vom 26. November 2012.

Der Einzelrichter zieht in Erwägung:

1.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Questão jurídica principal

Whether the federal appeal met the motivation requirements for admissibility.

Decisão extraída

The appeal did not sufficiently challenge the cantonal court’s reasoning and therefore failed to satisfy the statutory motivation requirements.

Fundamentação extraída

The appellant merely referred to the case file or argued on the merits, without explaining why the lower court’s finding of insufficient reasoning was wrong or arbitrary; this is insufficient under Art. 42(2) BGG, so the court could not enter into the appeal under Art. 108 BGG.

Questão jurídica principal

Whether the appellant was entitled to free legal aid.

Decisão extraída

The request for free legal aid was denied because the appeal had no prospect of success.

Fundamentação extraída

Since the appeal was inadmissible for lack of proper reasoning, the requests were deemed hopeless within the meaning of Art. 64 BGG.

Questão jurídica principal

Allocation of court costs.

Decisão extraída

Court costs were imposed on the appellant, taking his financial situation into account.

Fundamentação extraída

Costs follow the outcome; reduced consideration was given to the appellant’s financial circumstances under Art. 65(2) BGG.
