Resumo Omnilex

The Federal Supreme Court did not enter into the criminal complaint because the advance costs of CHF 2,000 were not paid within the set deadline. The appellants had requested an extension through their son while they were abroad, but the Court held that the son was not authorized to represent them in criminal matters and that no exceptional unforeseeable impediment justified a further extension of the non-extendable grace period. Court costs of CHF 800 were imposed on the appellants jointly and severally.

Sumário Omnilex

Art. 40 Abs. 1, Art. 66 Abs. 1 und Art. 108 BGG; advance costs, non-extendable grace period, and non-entry: a request for a further extension of an expressly non-extendable grace period for payment of advance costs is admissible only in the presence of exceptional, unforeseeable impediments. A person not authorized to act as representative before the Federal Supreme Court cannot validly seek such an extension. If the advance costs are not paid within the allotted time, the Court does not enter into the appeal in summary procedure; costs are allocated pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 20. Juli 2010
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Aargau, Frey-Herosé-Strasse 12, Wielandhaus, 5001 Aarau,
Beschwerdegegnerin.

Gegenstand
