Resumo Omnilex

The Federal Supreme Court did not enter into the appellant’s criminal complaint because it was insufficiently reasoned and did not address the decisive points of the cantonal decision, namely the summons to the district court hearing and her failure to appear. The appellant’s attack on the merits was inadmissible because the lower courts had not examined the substance. The request for legal aid was denied for lack of prospects of success. Court costs of CHF 500 were imposed on the appellant, with her financial situation taken into account.

Sumário Omnilex

Art. 42 Abs. 2 BGG, Art. 108 BGG; a federal appeal is inadmissible when it does not engage with the reasoning of the challenged decision and instead merely advances unreviewed substantive objections. The appellant must specifically address the decisive considerations; otherwise the court may decline to enter into the matter in summary procedure. A request for legal aid under Art. 64 BGG is refused if the appeal is manifestly devoid of prospects. Court costs are levied under Art. 66 Abs. 1 BGG, with account taken of the party’s financial circumstances pursuant to Art. 65 Abs. 2 BGG.

Urteil vom 4. Juli 2014

Strafrechtliche Abteilung

Besetzung
Bundesrichter Mathys, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführerin,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8090 Zürich,
Beschwerdegegnerin.

Gegenstand
Einsprache (Urkundenfälschung),

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 10. April 2014.

Der Präsident zieht in Erwägung:

1.

4.

Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.
