Resumo Omnilex

The Federal Supreme Court dealt with a complaint against a Bern appellate judgment convicting the appellant of repeatedly driving while his license had been revoked and sentencing him to 360 hours of community service, partly as a supplementary sentence. Most submissions were unrelated to the challenged judgment and therefore not examined. The bias allegation failed because judges' membership in the judicial system does not create an appearance of partiality. The appellant's reliance on Arts. 54 and 52 StGB was rejected: the asserted personal disadvantages did not justify waiving punishment and the guilt was not negligible. The complaint was dismissed insofar as admissible, legal aid was denied, and costs of CHF 800 were imposed.

Sumário Omnilex

Art. 95, 64, 65 Abs. 2, 66 Abs. 1 BGG; Art. 52 und 54 StGB; admissibility and substantive limits of a criminal complaint to the Federal Supreme Court. Submissions that do not address the reasoning of the contested judgment are inadmissible. An allegation of judicial bias cannot be derived merely from the fact that judges are part of the judicial apparatus. Art. 54 StGB requires exceptional consequences of the offence that make punishment inappropriate; ordinary collateral disadvantages of conviction do not suffice. Art. 52 StGB presupposes negligible guilt. Legal aid is refused where the appeal is manifestly hopeless; costs are allocated to the unsuccessful party, taking financial capacity into account.

Urteil vom 23. August 2010
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Bundesrichter Schneider, Mathys,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Generalprokurator des Kantons Bern, Maulbeerstrasse 10, 3011 Bern,
Beschwerdegegner.

Gegenstand
Fahren trotz entzogenen Führerausweises,

Beschwerde gegen das Urteil des Obergerichts des Kantons Bern, 2. Strafkammer, vom 16. April 2010.
Das Bundesgericht zieht in Erwägung:

1.

Strafkammer, schriftlich mitgeteilt.

Questão jurídica principal

Whether the complaint met the Federal Supreme Court's reasoning requirements and could be examined on the merits.

Decisão extraída

Only the arguments actually directed against the challenged judgment could be examined; the rest was inadmissible.

Fundamentação extraída

The complaint largely addressed hypothetical or unrelated matters and therefore did not show how the cantonal judgment violated federal law within the meaning of Art. 95 BGG.

Questão jurídica principal

Whether the cantonal judges were biased because they were part of the judicial apparatus.

Decisão extraída

No appearance of bias was established.

Fundamentação extraída

The mere fact that judges belong to the justice system does not, by itself, create an appearance of partiality.

Questão jurídica principal

Whether punishment should have been waived under Art. 54 StGB or reduced/dispensed with under Art. 52 StGB.

Decisão extraída

Neither Art. 54 StGB nor Art. 52 StGB applied.

Fundamentação extraída

The disadvantages alleged by the appellant, such as loss of assignments, restrictions on further training, and a worse reputation after conviction, were not reasons to forgo punishment; the guilt was also not so slight as to trigger Art. 52 StGB.

Questão jurídica principal

Whether the complaint should be upheld against the conviction and sentence for driving despite revoked license.

Decisão extraída

The complaint was dismissed insofar as it was admissible.

Fundamentação extraída

No federal-law violation was shown in the admissible parts of the complaint.

Questão jurídica principal

Whether court costs should be imposed and legal aid granted.

Decisão extraída

Legal aid was refused because the requested relief lacked prospects of success; court costs were imposed on the appellant with reduced fee consideration for his financial situation.

Fundamentação extraída

Under Arts. 64, 65(2), and 66(1) BGG, an unsuccessful complainant bears costs and may obtain legal aid only if the case is not hopeless.
