Resumo Omnilex

X.________ requested revision of a Federal Supreme Court judgment of 1 December 2007 that had not entered into his complaint for insufficient reasoning. The Criminal Division held that the revision request did not invoke any ground under Arts. 121-123 BGG and merely repeated arguments about a legal question of fundamental importance. That did not establish admissibility of the prior complaint or a revision ground. The court therefore did not enter into the revision request and imposed court costs of CHF 1,000 on the applicant.

Sumário Omnilex

Arts. 121-123 BGG; revision proceedings do not allow a party to circumvent the inadmissibility of the original complaint. Revision requires the invocation and substantiation of a statutory ground. A mere assertion that the underlying case concerned a legal question of fundamental importance does not constitute such a ground, nor does it remedy the lack of adequate reasoning required for the original complaint (consid. 1). Costs follow defeat under Art. 66 Abs. 1 BGG (consid. 2).

Urteil vom 8. Januar 2008

Besetzung
Bundesrichter Schneider, Präsident,
Bundesrichter Wiprächtiger, Ferrari,
Gerichtsschreiber Monn.

Parteien

Staatsanwaltschaft des Kantons Freiburg,

Gegenstand
Revision des Urteils des Bundesgerichts vom

  1. Dezember 2007 (6B_699/2007).

Das Bundesgericht zieht in Erwägung:
1.

Whether the revision request disclosed a statutory ground for revision under Arts. 121-123 BGG.

Decisão extraída

No statutory revision ground was invoked or shown; the request was therefore inadmissible.

Fundamentação extraída

The applicant merely repeated that the prior case concerned a legal question of fundamental importance. That would not cure the earlier failure to meet the admissibility and reasoning requirements, and it does not establish a revision ground.

Questão jurídica principal

Who bears the court costs of the revision proceedings?

Decisão extraída

The applicant must bear the costs.

Fundamentação extraída

Under Art. 66(1) BGG, costs are imposed on the unsuccessful party.
