Resumo Omnilex

K. challenged a Zurich Administrative Court decision in a social assistance matter. The Federal Supreme Court found that the appeal did not meet the mandatory reasoning requirements: it did not explain in a sufficiently concrete way why the lower-court judgment allegedly violated federal law, and the later supplementary letter did not cure this defect. Newly raised complaints about housing and rent expenses were based on cantonal law but were not precisely invoked as required. The additional allegation of racial discrimination was not examined. The court did not levy judicial costs, so the request for free legal aid became moot.

Sumário Omnilex

Art. 42 Abs. 1 and 2 BGG, Art. 106 Abs. 2 BGG; requirements for admissibility of a public-law appeal. The appeal must contain prayers and a concise, issue-specific reasoning showing, in a substantiated manner, in what respect the challenged decision violates law. General or unspecific criticism is insufficient. Alleged violations of cantonal law are reviewed only if expressly and precisely invoked and reasoned. Defects not cured within the appeal period lead to non-entry (consid. 1). If no court costs are levied, a request for free legal aid becomes moot (consid. 2).

Urteil vom 22. Oktober 2007
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.

Parteien
K.________, Beschwerdeführerin,

gegen

Gemeinde X._________, Beschwerdegegnerin,
vertreten durch die Sozialbehörde.

Gegenstand
Fürsorge,

Beschwerde gegen den Entscheid des Verwaltungsgerichts des Kantons Zürich
vom 4. Juli 2007.

Whether the public-law appeal met the Federal Supreme Court’s reasoning requirements.

Decisão extraída

The appeal did not satisfy the statutory requirements for a reasoned submission and could not be considered.

Fundamentação extraída

The filing lacked a sufficiently specific and issue-focused explanation of how the challenged judgment violated federal law. The later letter did not remedy this within the appeal period, and the complaints based on cantonal law were not properly and precisely raised under the applicable standard.

Questão jurídica principal

Whether alleged racial discrimination had to be examined in this proceeding.

Decisão extraída

The court did not examine the allegation in this proceeding because it was not within its competence here.

Fundamentação extraída

The newly asserted discrimination claim fell outside the scope of review in this case.

Questão jurídica principal

Whether court costs and legal aid had to be dealt with.

Decisão extraída

No court costs were levied, so the request for free legal aid became moot.

Fundamentação extraída

Because the court waived the collection of judicial costs, the application for free legal aid no longer required a separate decision.
