Resumo Omnilex

The Federal Supreme Court held that the appellant's challenge to the Bern cantonal social insurance judgment was inadmissible because the appeal neither contained a request nor met the minimum reasoning requirements of Art. 42 BGG. The submission did not engage with the cantonal court's assessment, in particular the income comparison, and did not properly show a violation of federal law or an obviously incorrect factual finding. The President therefore issued a simplified non-entry decision and waived court costs.

Sumário Omnilex

Art. 42 Abs. 1 and 2 BGG; Art. 95 f. BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG; insufficiently reasoned appeal and non-entry in simplified procedure. An appeal must contain conclusions and a concise statement of reasons setting out, in relation to the contested reasoning, why the decision violates federal law; mere criticism or a failure to engage with the decisive grounds is insufficient. If these minimum requirements are manifestly not met, the court may decline to enter into the appeal under the simplified procedure. Where no costs are imposed pursuant to Art. 66 Abs. 1 sentence 2 BGG, court fees may exceptionally be waived.

E.________,

Beschwerdegegnerin.

Gegenstand
Invalidenversicherung (Prozessvoraussetzung),

Oktober 2010.

Nach Einsicht
in die Beschwerde des E.________ vom 19. November 2010 (Datum des Poststempels) gegen den Entscheid des Verwaltungsgerichts des Kantons Bern, Sozialversicherungsrechtliche Abteilung, vom 20. Oktober 2010,
in Erwägung,

Whether the federal appeal met the formal requirements of Art. 42 BGG

Decisão extraída

No. The appeal contained neither a request nor an adequate explanation showing how the cantonal judgment violated federal law or incorrectly established facts.

Fundamentação extraída

The appeal did not address the cantonal court's reasoning, especially the income comparison, in a manner required by Art. 42 BGG and Art. 95 f. BGG; therefore it was manifestly inadmissible.

Questão jurídica principal

Whether the appeal could be dealt with in simplified procedure under Art. 108 BGG

Decisão extraída

Yes, the court could dispose of the manifestly inadmissible appeal in simplified procedure.

Fundamentação extraída

Because the appeal clearly failed the admissibility requirements, non-entry was appropriate under Art. 108 Abs. 1 lit. b BGG.
