Resumo Omnilex

The appellant sought university erasure based on exceptional personal circumstances. Medical certificates showed severe physical and psychological problems, including panic attacks, and significant professional hardship. The dean nevertheless denied that the situation was exceptional. CRUNI held that, in doing so, the dean exceeded his discretion. The appeal was therefore allowed and the refusal could not stand.

Sumário Omnilex

RU.22 al.3; university erasure and exceptional circumstances; discretion of the dean. Where medical certificates credibly establish serious physical and psychological illness, including panic attacks, together with substantial professional difficulties, the authority must recognize an exceptional situation. A refusal to do so, despite such evidence, constitutes an excessive exercise of discretion and is set aside (consid. unspecified).
