The recourant challenged the negative result of a driving examination in the context of an exchange of driving permits. The court held that such appeals are limited to reviewing abuse of discretion or breach of duty by the official examiner; it cannot reassess the substantive merits of the exam. Because the appellant had committed several errors, the examiner was entitled to conclude that he did not yet meet the requirements for a Swiss driving licence. The appeal was therefore dismissed.

Art. 22 LCR; review of driving examination results: the appellate authority cannot reassess the substantive merits of an exam because no legal standard permits such re-evaluation. It may only examine whether the official examiner abused discretion or breached official duties. Where the record discloses several errors by the candidate, the examiner may, without exceeding the margin of appreciation recognized by case law, conclude that the candidate does not yet possess the qualities required for the grant or exchange of a Swiss driving licence (consid. 1-2).

"En matière d'examens de conduite, un recours ne peut ainsi être formé que pour cause d'abus d'appréciation ou de violation des devoirs de fonction de l'expert officiel. En effet, l'autorité de recours n'a pas la possibilité d'examiner le bien-fondé des résultats d'un examen, car elle ne dispose pour cela d'aucun critère légal; elle doit se borner à rechercher s'il y a eu abus d'appréciation ou violation des devoirs de fonction de l'expert officiel (ATA N. du 10.12.1996 et G. du 12.03.1996; déc. DFJP G. du 12.12.1997 et Ch. du 15.10.1997). En l'espèce, le TA relève que le recourant a commis un certain nombre d'erreurs, en raison desquelles l'examinateur pouvait considérer, sans excéder le pouvoir d'appréciation qui lui est reconnu par la jurisprudence, qu'il ne possédait pas, au moment de l'examen, les qualités requises pour être mis au bénéfice d'un permis de conduire suisse". En matière d'examens de conduite, un recours ne peut être formé que pour abus d'appréciation ou violation des devoirs de fonction de l'expert officiel. L'autorité de recours n'a pas la possibilité d'examiner le bien-fondé des résultats d'un examen, ne disposant pour ce faire d'aucun critère légal.
