The Administrative Tribunal upheld a three-month disciplinary suspension of a pharmacist. He had repeatedly dispensed prohibited preparations, including thyroid-hormone slimming capsules and combinations of substances whose association was forbidden, sometimes without prescription and outside any emergency situation. Le TA a confirmé les 3 mois de suspension d'un pharmacien auquel il était reproché d'avoir vendu des préparations prohibées (hormones tyroïdiennes), partiellement sans ordonnance médicale et sans qu'il y ait une situation d'urgence. Ce comportement a été qualifié d'agissement professionnel incorrect. Le pharmacien qui délivre à maintes reprises des préparations interdites, soit des gélules amaigrissantes contenant une hormone thyroïdienne (art. 1 al. 1 RMA) ainsi que des préparations contenant des substances dont l'association est interdite (art. 1 al. 2 RMA) et qui soustrait astucieusement à toute investigation un ordonnancier affecté uniquement aux préparations précitées, commet de graves manquements professionnels justifiant sa radiation du registre des pharmaciens pour une durée de 3 mois .
