The insured suffered a dental injury while eating self-prepared birchermuesli containing a hazelnut shell fragment. The court held that the presence of the shell fragment was not reasonably foreseeable and that the record did not show a tooth weakness capable of breaking under normal pressure. The event therefore had the necessary accident character under Art. 9(1) OLAA.

An external event is extraordinary where the injured person, having prepared the meal himself, could not reasonably expect the presence of a shell fragment in the food. Accident character is not excluded absent proof that the affected tooth was so weakened that it would have broken under ordinary chewing pressure. The decisive factors are foreseeability of the foreign object and the absence of an alternative explanation based on pre-existing fragility (consid. as summarized).

Résumé

Ayant lui même préparé son birchermuesli, l'assuré ne pouvait raisonnablement s'attendre à trouver un reste de coquille de noisette dans son repas, la noisette étant facilement détachable de son écorce. Il ne ressort pas non plus du dossier que la dent fût si faible qu'elle n'eût pas résisté à une pression normale. Par conséquent, le caractère accidentel de l'événement doit être admis.
