La compétence de la confédération en matière d'économie viticole n'empêche pas les cantons de prendre eux-mêmes des mesures protégeant la culture de la vigne, pourvu que ces mesures ne soient pas contraires au statut du vin (art.47 du statut) - ATF 103 Ia 586, 591. Dans la mesure où l'AOVG ou l'APAGE utilisent effectivement la majorité des cotisations au fonds viticole dans le but de promouvoir les vins genevois, l'attribution de la totalité du fonds à ces deux organismes n'est pas contraire à la LUIT.
