The case concerns the monument protection classification of the building at 10 Place du Bourg-de-Four. The court held that the measure was no longer justified because the classification purpose, namely preventing the construction of an elevator, had ceased to exist. The Conseil d'État's order was therefore annulled.
LPMNS art. 10; monument protection classification may be annulled when the factual purpose underlying the measure has ceased to exist. A protective designation must remain materially justified by the conservation interest it is meant to serve; if the decisive ground disappears, the administrative measure loses its legal basis and cannot be maintained.
