The Federal Supreme Court addressed the conditions for a derogation from the ban on Sunday work for kiosks. Résumé

Le fait pour un kiosque de se situer à la seule proximité d'un arrêt de bus de campagne ne suffit pas pour considérer qu'il est "établi près des haltes des entreprises publiques de transport", au sens de l'art. 65 al. 2 litt. b OLTR II. En revanche, un tel établissement sis au coeur d'un point de correspondance (in casu 14 lignes de transports publics) remplit cette condition. L'octroi d'une dérogation à l'interdiction de travailler le dimanche implique également que l'on ait véritablement affaire à un kiosque, soit "une petite construction édifiée sur la voie publique où l'on vend des journaux, du tabac et des articles du même genre." La question de savoir si la caractéristique supplémentaire rattachée à ce type de construction par le TF doit être revue, soit le fait que la clientèle ne peut pas pénétrer à l'intérieur, est restée indécise.
