A driver acknowledged regular cannabis use before the police. In the preventive licence-withdrawal context, the authority wanted to order a psychiatric expert examination. The court held that this admission alone, given the absence of indications of psychological vulnerability, the person's regular work, the use of a friend's vehicle to come to Geneva, and the lack of any traffic-history problems, did not create a sufficient doubt as to driving fitness to justify such an expertise.

Art. 14 LCR; preventive assessment of driving fitness and ordering of a psychiatric expertise: a mere police admission of regular cannabis consumption does not, by itself, justify an expert psychiatric examination. An expertise may be ordered only where the file reveals concrete indications giving rise to serious doubt as to the person's fitness to drive. In the absence of signs of psychological instability, relevant traffic offences, or other objective elements casting doubt on capacity to drive, the administrative authority must refrain from ordering an expertise (consid. implied).
