The Administrative Tribunal interpreted Art. 15(3) LEXT to mean that buildings intended for international organizations need not be exclusively or entirely assigned to such organizations. It also held that an environmental impact study was not required for a 240-space parking lot. On the tree-felling issue, the court found that the authorization had not entered into force because it was not duly published under Art. 3(5) LCI, so opponents could still challenge it. Applying the coordination principle, the court remanded the matter to the LCI commission to reassess tree felling in light of the prior authorization. It further stated that the construction permit and tree-felling authorization must be published simultaneously to be attacked in one appeal.

Résumé

Le TA a interprété l'art.15 al.3 LEXT de la façon suivante : - les bâtiments destinés aux organisations internationales n'ont pas besoin d'être totalement affectés à une organisation internationale.

- Une étude d'impact n'est en l'espèce pas nécessaire pour un parking de 240 places.

- Faute d'avoir été régulièrement publiée (art.3 al.5 LCI) l'autorisation d'abattage d'arbres n'est pas entrée en force et les opposants à la requête pouvaient encore la remettre en cause devant la commission LCI. En application du principe de la coordination, qui vaut aussi dans le cas d'espèce, l'affaire a été renvoyée à la commission LCI pour qu'elle examine le problème de l'abattage en fonction de l'autorisation préalable (voire définitive de l'autorisation).

- L'autorisation de construire et celle d'abattre les arbres doivent être publiées simultanément pour qu'elles puissent faire l'objet d'un seul recours.
