Résumé

L'obligation de payer les primes avant de pouvoir changer d'assurance (art.9 al.3 OAMal) constitue une condition supplémentaire par rapport à la LAMal, qui est une entrave importante au principe du libre choix de l'assureur. Faute de base légale, elle ne doit pas être appliquée. Viole le principe de la légalité, l'obligation de payer les primes avant tout changement d'assurance (art. 9 al. 3 OAMal), dès lors qu'elle constitue une entrave importante au principe du libre choix de l'assureur non prévue par la LAMal.
