The applicants, a childless couple, sought a housing allowance after moving into a four-room apartment. En choisissant un appartement de quatre pièces, alors qu'ils auraient pu se contenter d'un appartement plus petit et moins cher sans inconvénients majeurs, le couple recourant (sans enfant) ne satisfait pas à l'une des conditions nécessaires à l'octroi d'une allocation de logement. Une occupation normale eût consisté à aménager dans un logement de trois pièces. Un couple sans enfant qui a emménagé dans un appartement de 4 pièces ne peut, pour fonder une demande d'allocation de logement, suppléer à la sous-occupation du logement par le souhait d'agrandir le groupe familial avec la venue d'un enfant non encore conçu.
