The case concerns a debtor who, after being in lasting insolvency, repaid CHF 3,600 in maintenance and offered to pay another CHF 1,800 the following month. The court held that these circumstances are enough to justify reconsidering whether lasting insolvency still exists. At the same time, it confirmed that SCARPA may primarily apply the amounts received to reimbursement of the state advance rather than to the children’s current maintenance. The appeal was therefore only partially successful.

Résumé

Un débiteur qui, après avoir été en insolvabilité durable, rembourse au Scarpa un montant de pensions alimentaires ne peut plus être considéré comme étant toujours en insolvabilité durable. Un débiteur qui, après avoir été en insolvabilité durable, rembourse au Scarpa une somme de trois mille six cent francs, tout en proposant de s'acquitter de mille huit cent francs le mois suivant ne peut plus être considéré comme étant toujours dans une telle situation; de tels indices suffisent à fonder une demande de réexamen auprès de ce service. Cependant, le Scarpa est en droit d'affecter prioritairement les montants précités au remboursement de l'avance consentie par l'Etat, plutôt qu'à l'entretien des enfants de la recourante.
