Art. 60 al. 1 LACI; review of the approval of a training measure project for unemployed persons: the competent authority enjoys a margin of assessment in determining whether a proposed measure is suitable and adapted to the target group. A refusal is not arbitrary where it rests on objective criteria, in particular the adequacy of the measure for the persons concerned, the coherence between the project’s scope and its intended purpose, and the qualifications of the persons responsible for implementation. The court intervenes only where the assessment is manifestly untenable or based on irrelevant considerations.

N'est pas arbitraire la décision de l'office cantonal de l'emploi rejetant le projet de créer une entreprise d'entraînement (virtuelle) destinée à des stagiaires chômeurs, aux motifs que les stages professionnels étaient mieux adaptés aux primo-demandeurs d'emploi, que le projet était trop large par rapport aux publics visés et que le directeur potentiel de cette entreprise ne disposait pas de suffisamment de compétences techniques au vu des objectifs visés.
