Le fait que l'accident devait être considéré comme étant de peu de gravité et que le motocycliste ait freiné dans un premier temps ne peut être retenu comme circonstance atténuante, celui-ci n'ayant pas voué toute son attention à ce danger tout le temps qu'une collision était possible.
