Pour déterminer les espaces communautaires, il ne s'agit pas de considérer l'utilisation des pièces faites par le locataire, mais bien la conception architecturale de l'appartement. En particulier, une cuisine et un coin à manger doivent être considérés comme constituant des espaces communautaires, de même que la pièce la plus grande servant de salon, sa transformation en chambre à coucher étant impratiquable compte tenu des placards fixes qui s'y trouvent.
