The Tribunal administratif allowed the appeal and annulled the administrative decision ordering a one-month driving-licence withdrawal. It held that the driver’s conduct on the motorway did not constitute a grave fault within the meaning of the Road Traffic Act. Because the applicant had been surprised by the abrupt slowing of the vehicle ahead, he could not be blamed for driving at an inappropriate speed for the road conditions.
