The case concerns an attempt by a municipal council president, who also held the office of deputy, to appeal a building permit decision on behalf of the municipality. The court held that neither the role of deputy nor that of municipal council president grants standing to appeal. Under the relevant municipal rules, the defense of municipal interests belongs to the administrative council, the mayor, or the mayor's deputies. The appeal was therefore dismissed as inadmissible for lack of standing.

Art. 60 lit. b LPA; municipal standing to appeal a construction permit decision: the capacity to defend the interests of a municipality and to act procedurally on its behalf belongs to the executive municipal authorities, namely the administrative council, the mayor and the deputy mayors. The president of the municipal council, even if simultaneously deputy, is not entitled to lodge an appeal in the name of the municipality.
