The case concerns entitlement to a housing allowance under RLGL.7 al.6. The beneficiary, who had set up a separate residence from the person with whom he had shared a household in order to 'take stock' and reflect, challenged the refusal of the allowance. The court held that a second dwelling adopted for reasons of personal convenience does not entitle the person to continued assistance. Contrairement au cas où l'OCL peut continuer à verser une allocation de logement à celui qui a été durant deux mois titulaire de deux baux, car il n'avait pu se libérer de manière anticipée d'un premier bail plus cher, il ne peut le faire dans le cas où l'un des bénéficiaires se constitue un domicile séparé de son co-locataire afin de "faire le point" et de "réfléchir". N'a pas droit à une allocation de logement celui qui, pour des motifs de convenance personnelle, dispose d'un second logement. Constitue un tel motif le souhait de "faire le point" dans un domicile séparé de celui occupé par la personne avec laquelle on faisait ménage commun.
