Les conditions du délai d'un an de l'art. 8 a LARPA ne s'appliquent pas à celui qui a quitté Genève pour vivre en France voisine avec sa mère, tout en continuant à poursuivre ses études à Genève, puis s'est constitué un nouveau domicile dans ce canton. Dans ce cas, l'alinéa 2 de la disposition précitée doit trouver application. La condition du délai d'attente d'un an (art. 8 al. 1 LARPA) ne s'applique pas à la personne qui a quitté Genève pour vivre en France voisine avec sa mère, tout en continuant à poursuivre ses études à Genève, puis s'est constitué un nouveau domicile dans ce canton. Dans ce cas, elle doit être mis au bénéfice de l'exception prévue à l'article 8 alinéa 2 LARPA.
