The court held that an open 33 m2 area with natural vertical light and connected to an 83 m2 room had to be treated as an additional room under the social housing rules. On that basis, the authority could not require the occupants to remain six persons in a five-room dwelling. The appeal was therefore successful to the extent that the housing situation had to be reconsidered in light of the correct room count.

RLGL.1 ch.3 litt.c; classification of living space in social housing; an open area may qualify as a room when, by its dimensions, natural lighting and functional integration with adjoining space, it presents the characteristics of an additional habitable room. In such circumstances, the occupancy assessment must be based on the actual number of rooms thus determined; an authority may not maintain an occupancy requirement that would compel an excessive density inconsistent with that classification.
