A hinterliess ihren Pflegesöhnen B, C und D zwei Grundstücke. Im Rahmen der partiellen Erbteilung trat C, über den vorher der Konkurs eröffnet worden war, seine Gesamteigentumsquote an den beiden Grundstücken an die Miterben B und D zu 1/3 des Anrechnungswertes der Grundstücke ab.

B verlangt mit Beschwerde die Aufhebung der Handänderungssteuerveranlagung, weil einerseits die ererbte Eigentumsquote vom Bruder erworben und anderseits damit deren Zwangsverwertung abgewendet worden sei.

Das Verwaltungsgericht hat die Beschwerde mit folgender Begründung abgewiesen:

    • Nach § 2 Ziff. 1 und 2 HStG unterliegen der Handänderungssteuer der Übergang des Eigentums an einem Grundstück im Sinne von Art. 655 Abs. 2 ZGB und die Änderung im Personenbestand von Gesamthandverhältnissen, die Veränderung der Anteilsrechte sowie die Aufhebung des Gesamteigentums. Steuerfrei ist der Übergang eines Grundstückes vom Erblasser an die Erbengemeinschaft (§ 3 Ziff. 3 HStG). Überdies sind Rechtsgeschäfte zwischen Verwandten in auf- und absteigender Linie steuerfrei (§ 3 Ziff. 2 HStG). Steuerpflichtig ist der Erwerber (§ 4 Abs. 1 HStG). Die Handänderungssteuer beträgt 1,5 % des Handänderungswertes (§ 6 HStG). Dieser besteht aus sämtlichen Leistungen des Erwerbers (§ 7 Abs. 1 HStG).
    • Im vorliegenden Fall wurde zu Recht nicht der Erwerb der Grundstücke durch B, C und D infolge Todes der Eigentümerin besteuert, sondern die Übernahme der Gesamteigentumsquote von C durch die Miterben B und D aufgrund der partiellen Erbteilung. Eine solche Änderung im Personenstand des Gesamthandverhältnisses stellt gemäss § 2 Ziff. 2 HStG eine steuerbegründende Handänderung dar, es sei denn, es läge eine Steuerbefreiung gemäss § 3 HStG vor. Als Brüder des Miterben C sind die steuerpflichtigen B und D keine Verwandten in auf- und absteigender Linie (§ 3 Ziff. 2 HStG). Eine Privilegierung für Handänderungen unter Geschwistern sieht das Handänderungssteuergesetz - entgegen dem Grundstückgewinnsteuergesetz - nicht vor. Somit stellt die vorliegende Handänderung keine steuerfreie Handänderung infolge Verwandtschaft dar. Inwiefern der Beschwerdeführer aus dem Hinweis, dass die beiden Halbschwestern der Verstorbenen ebenfalls Miterben gewesen seien, etwas zu seinen Gunsten ableiten könnte, legt er nicht dar und ist auch nicht ersichtlich, nachdem hier einzig der Erwerb der Gesamthandquote des C durch B und D zur Diskussion steht und daher gemäss § 4 Abs. 1 HStG ausschliesslich diese Miterben steuerpflichtig sind. Keine Rolle für die Erfüllung des steuerbegründenden Tatbestandes spielt dabei das Motiv der Erwerber. In § 3 HStG, wo die steuerfreien Handänderungen abschliessend aufgezählt sind (vgl. Urteil P. und B. vom 17. 9. 1985), wird der Erwerb aus Zwangsverkauf weder ausdrücklich noch sinngemäss erwähnt. Deshalb kann es dahinstehen, ob mit dem Auskauf von C einzig die Abwendung der drohenden Zwangsvollstreckung bezweckt wurde, wie dies der Beschwerdeführer geltend macht. Da sodann die Handänderungssteuer naturgemäss eine reine Rechtsverkehrssteuer ist (vgl. Urteil St. vom 6. 8. 1990 Erw. 4), berechnet sie sich einzig und allein aufgrund des Handänderungswertes. Dieser wird durch die Leistungen des Erwerbers bestimmt. Ob der Erwerber dazu Eigen- oder Fremdmittel verwendet, bleibt ohne Einfluss auf die Höhe des Handänderungswertes. Dasselbe gilt hinsichtlich der Art, wie der Erwerber tilgt, ob durch Barleistung, Verrechnung oder Schuldübernahme usw. Auch kann es nach dem Gesagten keine Rolle spielen, dass gemäss Darstellung des Beschwerdeführers kein erbschaftssteuerpflichtiges Reinvermögen resultiert habe, weil zur Auszahlung von Legaten und Pflichtteilen sowie zur Durchführung dringend notwendiger Unterhaltsarbeiten weitere Bankdarlehen hätten aufgenommen werden müssen. Somit steht fest, dass die Handänderungssteuer auf dem Auskaufbetrag geschuldet ist.
