§ 93 Abs. 2 VRG; expert challenge and late objection; failure to comply with a judicially fixed deadline does not per se extinguish the party’s right to object to the proposed expert. Where the law does not prescribe a specific expert, the parties must be afforded an opportunity to raise objections, and the recusal rules of §§ 14–16 VRG apply by analogy. Non-compliance with the deadline may instead be considered at the stage of costs under § 15 Abs. 3 VRG (consid. 3).

    • Soweit nicht bestimmte Sachverständige vorgeschrieben sind, gibt das Gericht den Parteien Gelegenheit, gegen den in Aussicht genommenen Sachverständigen Einwendungen zu erheben. Die Ausstandsbestimmungen der §§ 14 bis 16 VRG sind sinngemäss anwendbar (§ 93 Abs. 2 VRG). Im vorliegenden Verfahren ist zu beachten, dass der Beschwerdeführer innert der vom Gericht eingeräumten Frist zur Person von Dr. S keine Einwendungen geltend gemacht hat. Die Nichteinhaltung dieser gerichtlich eingeräumten Frist hat indes nicht die Unbeachtlichkeit des verspäteten Einwandes zur Folge. Allerdings wird sich im Endentscheid die Frage stellen, ob und allenfalls in welchem Mass die Nichteinhaltung der Frist im Kostenpunkt zulasten des Beschwerdeführers zu beachten sein wird (§ 15 Abs. 3 VRG; vgl. Kölz, Kommentar zum VRG des Kantons Zürich, N 31 Vorbemerkungen zu den §§ 19 bis 28 VRG).
