Aus den Erwägungen:

    • In materieller Hinsicht macht der Beschwerdeführer geltend, nach § 52 StrG sei die Strassengenossenschaft Eigentümerin der Hauptgüterstrasse und trage für diese die Strassenbaulast. Dies könne sie nur, wenn die Strasse ausparzelliert sei. Der angefochtene Entscheid, mit dem die Parzellierung ausgeschlossen werde und die Strasse nunmehr als Kulturart vermessen werde, widerspreche somit dieser Bestimmung.

Die zitierte Bestimmung von § 52 StrG hält zwar als Regel fest, dass die Strassengenossenschaft Eigentümerin der Strasse wird, was eine Ausmarchung des Strassenterrains bedingt. In Satz zwei behält diese Bestimmung aber ausdrücklich besondere Rechtsverhältnisse vor. Auf die Ausmarchung kann daher ohne weiteres verzichtet werden (Urteil R. vom 22.9.1977; LGVE 1982 II Nr. 6). Entgegen der Auffassung des Beschwerdeführers sind für den Verzicht auf die Ausmarchung keine speziellen Voraussetzungen vorgeschrieben. Der angefochtene Entscheid verstösst somit nicht gegen § 52 StrG.
