The Government Council held that a new driving test is required under Art. 14(3) SVG whenever doubts arise as to a driver's suitability, especially as to driving skill and knowledge of traffic rules. Such doubts may rest on numerous prior offenses or on a single serious violation from which deficient driving knowledge can be inferred. The challenged order to undergo a new examination was therefore upheld.

Eine neue Führerprüfung ist anzuordnen, wenn Bedenken hinsichtlich der Eignung des Führers bestehen, namentlich in bezug auf Fahrfertigkeit und Kenntnis der Verkehrsregeln. Die Bedenken können sich entweder auf zahlreiche Vorstrafen oder aber nur auf eine einzelne schwere Widerhandlung stützen, woraus der Schluss auf mangelnde Fahrkenntnisse zu ziehen wäre.
