Art. 4 LEG.

Die Entlassung aus der Unterstellung hat vorbehaltlos zu erfolgen.

Entscheid des Regierungsrates vom 23. Mai 1972 (Nr. 94).

Die eidgenössische und kantonale Gesetzgebung über die Entschuldung landwirtschaftlicher Heimwesen umschreiben einlässlich die Voraussetzungen für die Unterstellung von Grundstücken unter die entsprechenden gesetzlichen Bestimmungen. Bei Vorliegen dieser Voraussetzungen sind die Grundstücke mangels anderweitiger Regelung vorbehaltlos den entsprechenden Normen zu unterstellen. Dasselbe hat auch für die Entlassung aus der Unterstellung zu gelten. Stellt die kantonale Bodenrechtskommission aufgrund eines Gesuches fest, dass sich die Verhältnisse bei einem Grundstück in der Weise geändert haben, dass es den Voraussetzungen des LEG für die Unterstellung nicht mehr entspricht, so hat sie diese Liegenschaft vorbehaltlos, d.h. ohne jegliche Auflagen, aus der Unterstellung zu entlassen. Die Befugnis, eine Entlassung mit bestimmten Auflagen zu verbinden, müsste ausdrücklich im Gesetze verankert sein, wie dies beispielsweise in der Gesetzgebung betreffend Grundstückverkäufe an Ausländer der Fall ist.
