The Administrative Court held that, in administrative-court appeal proceedings, a party may not expand or substantively alter the requests made in the lower-instance proceedings. The court can review the complaint only if it concerns the same requests as those raised below. Any requests going beyond the earlier application are not considered.

The reviewing court may assess the complaint only within the limits of the requests already made before the lower authority. Die Parteien können die im vorinstanzlichen Verfahren zur Sache gestellten Anträge nicht ausdehnen oder inhaltlich ändern.

Entscheid des Verwaltungsgerichtes vom 22. Januar 1975.

Aus den Erwägungen:

Mit der verwaltungsgerichtlichen Beschwerde wird der Entscheid der Vorinstanz gerügt. Das Verwaltungsgericht kann die Beschwerdegründe nur überprüfen, wenn es sich mit den gleichen Anträgen befasst wie die Vorinstanz. Dies bedeutet für den Beschwerdeführer, dass die im vorinstanzlichen Verfahren zur Sache gemachten Anträge vor dem Verwaltungsgericht inhaltlich weder ausgedehnt noch geändert werden dürfen... .

Soweit die im verwaltungsgerichtlichen Beschwerdeverfahren gestellten Anträge über die im vorinstanzlichen Verfahren angebrachten hinausgehen, wird auf sie nicht eingetreten.
