In Obwalden administrative proceedings, the Government Council confirmed its settled practice of granting a second written exchange only with extreme restraint. Such an exchange is allowed only when required for proper instruction of the case or when the appeal response contains new factual allegations that the appellant could not previously know. The Council saw no reason to depart from this practice, noting that even in administrative court proceedings a second exchange is not available as a matter of course.

In Obwalden, the authorities may allow an additional exchange only where the clarification of the case so requires or where the response introduces new factual allegations unknown to the complainant beforehand. The restraint is justified by the need to avoid undue hindrance of administrative business. The same cautious approach applies mutatis mutandis in administrative judicial proceedings; there is no general entitlement to a second exchange (consid. 1).

Im Obwaldner Verwaltungsverfahren ist es feste Praxis, einen zweiten Schriftenwechsel nur mit äusserster Zurückhaltung zu gewähren, weil sonst der Verwaltungsbetrieb zu stark gehemmt werden könnte. Er kam bisher nur dann vor, wenn er für die Instruktion des Falles notwendig war, oder wenn in der Beschwerdeantwort neue tatsächliche Behauptungen enthalten waren, die der Beschwerdeführer im voraus nicht wissen konnte. Es gibt keinen Grund, von dieser zurückhaltenden Praxis abzuweichen, zumal auch im verwaltungsgerichtlichen Verfahren nicht schon zum vorneherein die Möglichkeit des zweiten Schriftenwechsels besteht.
