Art. 4 Abs. 3 BMR; Standortbedingtheit eines Neubaus: Wer bereits über ein Wohnhaus verfügt und dieses vermietet, kann die daraus selbst geschaffene Bedarfslage nicht als Begründung für die Standortgebundenheit eines Neubaus anrufen. Eine derartige Argumentation ist als rechtsmissbräuchlich abzulehnen; unter diesen Umständen fehlt es an der Standortbedingtheit des Bauvorhabens.

Art. 4 Abs. 3 BMR.

Keine Standortbedingtheit eines Neubaus, wenn der dem gleichen Eigentümer gehörende Altbau vermietet wird.

Entscheid des Regierungsrates vom 19. Februar 1974 (Nr. 1508).

Es geht nicht an, dass jemand, der bereits ein Wohnhaus sein Eigentum nennt, dieses vermietet und nachher aufgrund dessen behauptet, er sei nun auf einen Neubau angewiesen. Eine diesbezügliche Argumentation muss entschieden abgelehnt werden. Wollte man diese Praxis schützen, würde auch der Rechtsmissbrauch geschützt. Unter diesen Umständen kann das Bauvorhaben nicht als standortbedingt bezeichnet werden.
