The court held that an indefinite suspension of criminal proceedings, caused by the complainant’s removal to Spain and the resulting impossibility of a confrontation hearing, is an interlocutory decision. Because resumption was not foreseeable and any final decision on costs might be postponed for years, the court found it permissible and appropriate to decide the compensation of the complainant’s court-appointed counsel already in the suspension order. Point 3 of the challenged order, which deferred costs to the merits, was therefore annulled, and the lower court was instructed to decide the counsel’s compensation.

2.    Bei der angefochtenen Sistierungsverfügung handelt es sich um einen Zwischenentscheid (Nathan Landshut in: Donatsch Andreas/Hansjakob Thomas/Lieber Viktor, Kommentar zur Schweizerischen Strafprozessordnung, Art. 314 StPO N 1; BGE 122 II 211 E. 1c). In Art. 421 Abs. 2 lit. a StPO ist die Möglichkeit vorgesehen, bereits in einem Zwischenentscheid – und nicht erst im Endentscheid (Art. 421 Abs. 1 StPO) – über die Kosten zu befinden.

Im vorlieenden Fall wurde das Strafverfahren für unbestimmte Zeit sistiert, weil der (unentgeltlich verbeiständete) Privatkläger als Asylbewerber nach Spanien ausgeschafft wurde, keine Adresse von ihm ausfindig gemacht weden konnte und damit – zumindest zur Zeit – keine Konfrontationseinvernahme zwischen ihm und der beschuldigten Person stattfinden kann. Wann und ob der Sistierungsgrund wegfällt, ist äusserst ungewiss. Da aber mit der Wiederaufnahme des Verfahrens in absehbarer Zukunft nicht zu rechnen ist, kann ein Entscheid über die Verfahrenskosten, der erst im Endentscheid ergeht (vgl. Art. 421 Abs. 1 StPO), dem unentgeltlichen Rechtsbeistand nicht zugemutet werden. Allenfalls würde erst mit der Einstellung des Strafverfahrens wegen Eintritts der Verjährung über die ihm zustehende Entschädigung befunden (vgl. Art. 319 Abs. 1 lit. d StPO). Die Verjährung würde im vorliegenden Fall erst 15 Jahre nach der mutmasslichen Tatbegehung vom 27. Mai 2010, somit im Jahre 2025, eintreten (vgl. Art. 123 i.V.m. Art. 97 Abs. 1 lit. b StGB). Unter solchen Voraussetzungen macht es Sinn, über die Entschädigung des unentgeltlichen Rechtsbeistands des Privatklägers für den bisherigen Aufwand zu entscheiden. In einem derartigen Fall ist ein Kostenentscheid in der Sistierungsverfügung angebracht und der unentgeltliche Rechtsbeistand auf Ersuchen hin vorläufig zu entschädigen. Ziffer 3 der angefochtenen Sistierungsverfügung, wonach die Kosten bei der Hauptsache bleiben, ist aufzuheben. Die Vorinstanz hat über die Entschädigung des Anwalts des Beschwerdeführers als unentgeltlicher Rechtsbeistand noch zu entscheiden.
