As a rule, the current family’s existential minimum is to be safeguarded (consid. unspecified), so that recourse to social assistance is avoided; the spouse aware of the existing maintenance obligations must, however, cooperate in meeting them. The spouse is therefore to be included in the budget calculation, but no hypothetical income may be imputed where gainful employment is unreasonable, notably in view of childcare and full-time studies. Conversely, study costs and childcare costs of the new spouse are not to be charged to the family budget. Only proven illness-related additional expenses and the ordinary minimum needs are to be taken into account; unproven medical costs and taxes are excluded.

Ob das Existenzminimum des Unterhaltspflichtigen mit seiner Ehefrau und dem gemeinsamen Kind bei der Festlegung der Unterhaltsbeiträge für das voreheliche Kind zu wahren ist, ist bis heute nicht ganz geklärt. In der Regel wird dies aber angenommen (KGer SG, FamPra.ch 2008, 190; Hausheer/Spycher, Unterhalt nach neuem Scheidungsrecht, N 08.05; Raselli/Möckli, Aktuelle Fragen des nachehelichen Unterhalts, in: Schwenzer/Büchler [Hrsg.], Dritte Schweizer Familienrechtstage, 3, 22; anders noch BGE 127 III 68, 70). Damit soll wenigstens einer Seite der Gang zum Sozialamt erspart bleiben, zumal der Anspruch der neuen Familie auf Sozialhilfe fraglich wäre. Immerhin ist aber zu beachten, dass die Ehefrau die finanziellen Verbindlichkeiten des Partners kannte und ihn bei deren Erfüllung unterstützen muss (FamKomm Scheidung/Schwenzer, Art. 125 N 29 und Art. 129 ZGB N 11). Die Ehefrau ist demnach in die Notbedarfsberechnung mit einzubeziehen. Ihr kann kein (hypothetisches) Einkommen angerechnet werden, ist doch neben der Betreuung des dreijährigen Kindes und dem Vollzeitstudium eine Beschäftigung nicht zumutbar. Im Gegenzug aber sind die Studienkosten der Ehefrau und die Kinderhortkosten nicht in den Bedarf aufzunehmen. Der Unterhaltsanspruch des Kinds aus der früheren Beziehung soll nicht geschmälert werden, nur weil die Ehefrau des Vaters sich einem Studium widmet. Der Bedarf der Familie ist also auf das Existenzminimum zu beschränken. Dieses setzt sich hier aus dem Grundbetrag für ein Ehepaar, dem Zuschlag für das Kind D., den obligatorischen Krankenkassenprämien, dem Mietzins sowie den Kosten für den öffentlichen Verkehr und Versicherungen zusammen. Beim an Diabetes leidenden Vater sind zudem krankheitsbedingte Mehrkosten in der Höhe von monatlich Fr. 70.– zu berücksichtigen. Ebenso sind die ausgewiesenen Krankheitskosten von D. in den Bedarf aufzunehmen. Nicht zu berücksichtigen sind hingegen die Krankheitskosten der Ehefrau, ist doch nicht erstellt, dass diese regelmässig anfallen. Auch die Kosten für die Zahnbehandlung des Vaters werden nicht in den Bedarf aufgenommen, da die medizinische Notwendigkeit nicht belegt ist. Ebenso werden praxisgemäss die Steuern nicht berücksichtigt (Bühler, Betreibungs- und prozessrechtliches Existenzminimum, AJP 2002, 655).
