Maintenance may be owed even where the recipient spouse can cover own living expenses, if a substantial income disparity exists and the contribution serves to equalize the spouses’ living standards. A merely slight difference does not suffice; an appreciable gap creating a real social disparity is compensable.

Aus den Erwägungen:

Beim Ehegattenunterhalt ist – im Unterschied zum nachehelichen Unterhalt – nicht die Frage entscheidend, ob ein Ehegatte seinen Lebensbedarf selbst finanzieren kann oder nicht. Der Ehegattenunterhalt hat vielmehr den bisherigen ehelichen Lebensstandard zu gewährleisten oder zumindest sicherzustellen, dass jeder Ehegatte denjenigen Lebensstandard hat, den sich auch der andere leisten kann (KGer SG, FamPra.ch 2008, 176, 177; Lötscher/Trinkler, Unterhalt bei knappen bis mittleren finanziellen Verhältnissen, FamPra.ch 2004, 828, 830). Demnach ist auch in einer langjährigen Doppelverdienstehe Ehegattenunterhalt geschuldet, soweit mit dem Unterhaltsbeitrag nicht bloss eine geringfügige Differenz, sondern ein erhebliches Einkommensgefälle ausgeglichen wird (KGer SG, FamPra.ch 2003, 647, 649; Hausheer/Spycher, Unterhalt nach neuem Scheidungsrecht, N 05.43, 05.114; FamKomm Scheidung/ Schwenzer, Art. 125 ZGB N 45). Hier verdient der Ehemann als Speditionsleiter rund Fr. 5'900.– netto im Monat. Die Ehefrau erreicht als Lehrerin ein monatliches Nettoeinkommen von Fr. 8'000.–. Ein Einkommensunterschied von über Fr. 2'000.– im Monat ist offensichtlich nicht geringfügig oder gar vernachlässigbar, sondern bewirkt einen eigentlichen sozialen Klassenunterschied zwischen den Eheleuten. Dieser ist auszugleichen.
