The court held that the lower court correctly refused to enter into the civil claims of plaintiffs 2-6. It stated that the earlier practice under Art. 36(3) last sentence aStP could not survive the revised Criminal Procedure Code of 1 July 1999. The new Arts. 43 ff. StP establish a simplified and uniform regime for civil claims and deliberately do not reserve the Victim Assistance Act under Art. 44(2) sentence 2 StP.

Aus den Erwägungen:

  1. Auf die Zivilforderungen der Kläger 2-6 ist die Vorinstanz zutreffend nicht eingetreten; es kann im Grundsatz auf ihre Erwägungen verwiesen werden. Die Praxis zu Art. 36 Abs. 3 letzter Satz aStP kann unter dem revidierten Strafprozessgesetz vom 1. Juli 1999 nicht aufrechterhalten werden. Der Gesetzgeber hat in den Art. 43 ff. StP für die Zivilklage eine vereinfachte, einheitliche Regelung geschaffen, die Opferrechte ausdrücklich im kantonalen Prozessrecht verankert und insbesondere gegenüber Art. 44 Abs. 2 Satz 2 StP die Bestimmungen des Opferhilfegesetzes bewusst nicht vorbehalten (vgl. Begleitender Bericht zum Vorentwurf Totalrevision StP vom 25. Oktober 1995 S. 25 f.; Vernehmlassung des Kantonsgerichts hierzu vom 8. März 1996 S. 9; Botschaft StP vom 30. Juni 1998, ABl 1998 1479).
