SOG 1985 Nr. 34 **§ 52 Abs. 2 GO.*Zur Kognition des Verwaltungsgerichtes bei der Überprüfung von Bewilligungserteilungen Bei der Behandlung einer Beschwerde gegen das Forstdepartement, welche die Erteilung einer Ausnahmebewilligung nach § 9 des kant. Gesetzes über das Forstwesen (Waldabstand) betraf, stellte das Verwaltungsgericht in seinen Urteilserwägungen fest, dass ein bestimmter Einwand des Beschwerdeführers eine Ermessensfrage betraf. Bezüglich seiner Befugnis, dieses Ermessensfrage zu überprüfen, führte das Gericht folgendes aus: Dem Verwaltungsgericht steht zwar auf Grund von § 52 Abs. 2 GO im vorliegenden Verfahren auch die Ermessensüberprüfung zu. Allein, es ist unumgänglich und ist allgemeine Praxis, dass bei der Überprüfung von Bewilligungserteilungen die verwaltungsgerichtlichen Behörden auch dann, wenn ihnen die Ermessensüberprüfung zusteht, der Bewilligungsbehörde, welche die primäre Verantwortung für eine gleichmässige Ermessenspraxis übernehmen muss, einen recht weiten Beurteilungsspielraum zugestehen. * Verwaltungsgericht, Urteil vom 19.
