SOG 1987 Nr. 21 **§§ 119 und § 173 Abs. 3 StPO.*Beurteilt der erstinstanzliche Richter eine ihm durch Schlussverfügung des Untersuchungsrichters überwiesene Straftat nicht kommt dies einem Freispruch gleich (Bestätigung der Praxis). Der Untersuchungsrichter warf X. u.a. vor, sich des Amtsmissbrauches schuldig gemacht zu haben, indem er einen amtlichen Ausweis abgeändert habe, ohne dazu befugt gewesen zu sein. Das Amtsgericht sprach X. wegen eines anderen, vom Untersuchungsrichter als Nötigung qualifizierten Vorfalles des Amtsmissbrauches schuldig, erwähnte das Abändern des Ausweises in seinem Urteil indessen nicht. Der Staatsanwalt appellierte gegen das Urteil des Amtsgerichtes, beschränkte seine Appellation jedoch auf einzelne Punkte des Urteilsdispositives. Das Obergericht prüfte die Frage, ob das eigenmächtige Abändern des Ausweises Gegenstand des Appellationsverfahrens bildete: Das Abändern des Ausweises, die gesetzliche Bezeichnung der Straftat (als Amtsmissbrauch) und die als anwendbar erachteten Strafbestimmungen waren in der Schlussverfügung des Untersuchungsrichters enthalten und bildeten folglich Gegenstand der Entscheidung (RB 1973 Nr. 21). Das Amtsgericht ging jedoch weder im Dispositiv noch in den Erwägungen seines Urteils darauf ein, so dass darüber formell kein Entscheid getroffen wurde. Nach ständiger Rechtsprechung des Obergerichts (RB 1963 Nr. 23) kommt dies einem Freispruch gleich. Das Abändern des Ausweises ist indessen nicht Gegenstand des Appellationsverfahrens, weil es einen selbständigen und aus dem äusseren Zusammenhang isolierbaren Lebensvorgang darstellt, der, in der Schlussverfügung als Amtsmissbrauch qualifiziert, durch die Beschränkung der Appellation auf andere Vorhalte der Überprüfung durch das Obergericht entzogen ist. * Obergericht Strafkammer, Urteil vom 7.
