In moratorium proceedings the applicant debtor is the sole party and must bear the court costs even when the application is fully granted, the moratorium is extended, or the composition agreement is approved. A removed administrator has no party quality and therefore cannot be charged with court costs or ordered to pay party compensation. Likewise, a creditor whose appeal is admitted acquires standing to appeal but not party status for purposes of cost allocation; where no losing party exists, all party costs are offset.

SOG 1996 Nr. 13 **§ 101 ZPO.*Kosten- und Entschädigungsentscheid im Einparteienverfahren. Im Nachlassverfahren ist immer der Nachlassschuldner als Gesuchsteller kostenpflichtig. Der Gerichtspräsident gewährte X. die Nachlassstundung und setzte A. als Sachwalter ein. Dagegen appellieren X. sowie Y., ein Gläubiger von X. Das Obergericht heisst die Appellation gut und ersetzt A. durch B. 13. Bei der Liquidation von Kosten und Entschädigung ist zu beachten, dass es sich um ein zivilprozessual untypisches Einparteienverfahren handelt. Die übliche Regel von § 101 ZPO kann nicht einmal analog angewandt werden, da es an einer unterliegenden Partei mangelt. Die abgesetzte Sachwalterin A. dringt zwar mit ihren Anträgen nicht durch, hat aber nicht Parteiqualität. Ihr können deshalb weder Gerichtskosten auferlegt noch kann sie zu einer Parteientschädigung an die Appellanten verpflichtet werden. Die Appellantin X. obsiegt zwar, ist aber als Nachlassschuldnerin die einzige Partei. Ihr fehlt die Gegenpartei, die zu Kosten verpflichtet werden könnte. Gerade deshalb hat ein Gesuchsteller die Kosten des Nachlassrichters immer auch dann zu bezahlen, wenn er vollständig obsiegt, also etwa die Nachlassstundung antragsgemäss bewilligt, der von ihm gewünschte Sachwalter eingesetzt, die Nachlassstundung verlängert und der Nachlassvertrag vollumfänglich genehmigt wird. Die Gerichtskosten sind eine Gebühr für die Inanspruchnahme einer staatlichen Tätigkeit. Sie können nur dann auf einen anderen abgewälzt werden, wenn ein solcher überhaupt vorhanden ist, mithin im Zweiparteienverfahren. Andernfalls hat der Gesuchsteller diese Kosten zu tragen. Daher erliegen auch die zweitinstanzlichen Gerichtskosten auf der Appellantin X. als Nachlassschuldnerin. Ihr kann auch keine Parteientschädigung zugesprochen werden. Zu Lasten des Staates besteht diese Möglichkeit ohnehin nur bei integraler unentgeltlicher Rechtspflege gemäss §§ 106 ff. ZPO (oder allenfalls gestützt auf das Verantwortlichkeitsgesetz). Auch dem Appellanten Y. schliesslich kann keine Parteientschädigung ausgerichtet werden. Auch er obsiegt zwar, ist aber nicht im eigentlichen Sinne Partei. Dass ihm in ständiger Praxis die Legitimation zur Appellation zugesprochen wird, macht das Verfahren nicht in zweiter Instanz zu einem Zweiparteienprozess. Hinzu kommt, dass wie erwähnt eine unterliegende Partei fehlt. A. verliert, ist aber nicht Partei, X. ist zwar Partei, hat aber ebenfalls obsiegt.
