The accused had objected to a penal order issued by the public prosecutor, but withdrew the objection during the hearing before the Pretura penale. The judge therefore struck the matter from the docket and declared the penal order enforceable. The court also ordered that no court fees or costs be charged for the present decision.
Arts. 210-211 CPP; withdrawal of objection against a penal order: if the objecting party withdraws the objection during the hearing, the court strikes the proceedings from the roll and the penal order becomes enforceable. In such a case, the objection proceedings are terminated without a merits review; the court may also order that no fees or costs be charged.
