Art. 352 cpv. 1 CPC; withdrawal of an appeal and costs. The withdrawal of an appeal is equivalent to desistance and ordinarily leads to the withdrawing party being treated as unsuccessful. Exceptionally, however, the appellate court may waive court fees and party compensation where the appeal was withdrawn before service on the respondent and the latter therefore incurred no expenses. Such waiver rests on the concrete circumstances of the case and does not alter the general rule that desistance entails loss for the withdrawing party.

premesso che il 25 novembre 1999 __________ ha introdotto appello contro un decreto cautelare emanato dal Pretore l'11 novembre 1999;

preso atto che il 2 dicembre 1999 essa ha dichiarato di ritirare l'appello, il convenuto avendo accettato spontaneamente, nel frattempo, di dare informazioni sui propri redditi;

ricordato che il ritiro di un appello equivale a desistenza (Rep. 1978 pag. 375), sicché l'interessata andrebbe considerata soccombente;

osservato nondimeno che l'appellante sembra avere ricorso per avere frainteso la portata della sentenza apparsa in Rep. 1997 pag. 121;

accertato inoltre che al momento del ritiro l'appello non era ancora stato intimato al convenuto, il quale non ha quindi dovuto affrontare spese;

ritenuto che nelle circostanze descritte si giustifica – eccezionalmente – di rinunciare tanto al prelievo di oneri processuali quanto all'attribuzione di ripetibili;

richiamato l'art. 352 cpv. 1 CPC,

decreta: 1. La causa è stralciata dai ruoli per desistenza.

  1. Non si riscuotono tasse o spese né si assegnano ripetibili.
